These Terms and Conditions (“Terms”) govern access to and use of EZ Product Options (the “App”), provided by Z Dzine (“Z Dzine,” “we,” “us,” or “our”). By installing, accessing, or using the App, the Shopify merchant accepting these Terms (“Merchant,” “you,” or “your”) agrees to be bound by them.
1. Eligibility and authority
You must have authority to act for the Shopify store on which the App is installed and be legally capable of entering into these Terms. Your use of Shopify remains governed by your separate agreement with Shopify.
2. App service
The App enables merchants to configure and display product-option fields, personalization choices, swatches, file uploads, conditional logic, price add-ons, and reusable option sets. Available features may change as we improve the App. Some features may depend on the merchant’s Shopify plan, theme, configuration, third-party services, or Shopify platform capabilities.
3. Merchant responsibilities
You are responsible for:
- Configuring, previewing, and testing option fields before publishing them.
- Ensuring product descriptions, option labels, pricing, taxes, fulfillment terms, and shopper-facing information are accurate.
- Reviewing cart and checkout behavior after theme, product, market, currency, or App changes.
- Obtaining all rights and consents needed for information and files you request from shoppers.
- Providing legally required notices and honoring customer rights.
- Maintaining the security of your Shopify account and limiting staff access appropriately.
- Using the App in compliance with law, Shopify policies, and these Terms.
4. Prohibited use
You may not use the App to violate law or third-party rights; collect passwords, payment-card data, or unnecessary sensitive information; distribute malware; interfere with the App; bypass access or billing controls; reverse engineer the App except where law prohibits restriction; or use the App for fraudulent, deceptive, abusive, or harmful activity.
5. Merchant content
You retain ownership of product configurations, text, images, option content, and other materials you provide (“Merchant Content”). You grant us a limited right to host, process, reproduce, transmit, and display Merchant Content only as needed to operate, secure, support, and improve the App. You represent that you have the rights needed to use Merchant Content.
6. Shopper submissions
You control the option fields presented to shoppers and are responsible for the purpose and lawfulness of shopper submissions. We process those submissions only as needed to provide the App and as otherwise described in the EZ Product Options Privacy Policy.
7. Fees and billing
Paid subscriptions, trials, and usage charges, if offered, are presented through Shopify and billed according to the plan selected by the Merchant and Shopify’s billing processes. Applicable fees and billing intervals are shown before approval. Taxes may apply. Uninstalling the App stops future App use but does not automatically entitle you to a refund for charges already incurred, except where required by law or expressly stated.
8. Support and updates
We provide reasonable support through the contact channels listed on our website. Response times are not guaranteed unless a separate written service-level agreement applies. We may release fixes, updates, or feature changes and may require reasonable configuration changes to maintain compatibility.
9. Availability and Shopify dependencies
We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability. The App relies on Shopify, internet services, themes, browsers, and other systems outside our control. Maintenance, security incidents, platform changes, or events beyond reasonable control may affect availability.
10. Intellectual property
The App, software, design, documentation, branding, and related materials are owned by Z Dzine or its licensors and are protected by intellectual-property laws. These Terms grant only a limited, non-exclusive, non-transferable, revocable right to use the App for your Shopify store during an active subscription or authorized access period.
11. Confidentiality
Each party may receive non-public information from the other. The receiving party will use reasonable care to protect confidential information and use it only to perform obligations or exercise rights under these Terms, except where disclosure is required by law.
12. Privacy and data protection
Our processing practices are described in the EZ Product Options Privacy Policy. Each party will comply with applicable data-protection obligations relevant to its role. Merchants must minimize data collection and avoid requesting information that is not necessary for product customization or fulfillment.
13. Disclaimers
To the maximum extent permitted by law, the App is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing. We do not guarantee that App configurations will satisfy your legal, tax, pricing, accessibility, or business requirements.
14. Limitation of liability
To the maximum extent permitted by law, Z Dzine will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption. Our aggregate liability arising from the App will not exceed the amount paid by you for the App during the six months preceding the event giving rise to the claim. Some jurisdictions do not permit certain limitations, so parts of this section may not apply.
15. Indemnification
To the extent permitted by law, you agree to defend and indemnify Z Dzine against third-party claims arising from your Merchant Content, your configuration or use of the App, your products or storefront, your violation of law or these Terms, or your infringement of third-party rights.
16. Suspension and termination
You may stop using the App by uninstalling it. We may suspend or terminate access where reasonably necessary for security, non-payment, prohibited conduct, legal compliance, Shopify requirements, or material breach. Provisions that by their nature should survive termination—including intellectual property, disclaimers, liability limits, and dispute provisions—will survive.
17. Changes to these Terms
We may update these Terms to reflect service, legal, or operational changes. We will revise the “Last updated” date and provide additional notice where required. Continued use after an update takes effect constitutes acceptance to the extent permitted by law.
18. Governing terms and disputes
These Terms are governed by the laws applicable where Z Dzine is legally established, excluding conflict-of-law rules. The parties will first attempt in good faith to resolve disputes informally. Nothing in these Terms limits mandatory rights or remedies that cannot lawfully be excluded.
19. General
These Terms and the referenced Privacy Policy form the agreement concerning the App unless a separate written agreement applies. If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, merger, acquisition, or transfer of the App.
