These Terms and Conditions (“Terms”) govern access to and use of EZ Forms (the “App”), provided by Z Dzine (“Z Dzine,” “we,” “us,” or “our”). By installing, accessing, or using the App, the Shopify merchant accepting these Terms (“Merchant,” “you,” or “your”) agrees to be bound by them.
1. Eligibility and authority
You must have authority to act for the Shopify store on which the App is installed and be legally capable of entering into these Terms. Your use of Shopify remains governed by your separate agreement with Shopify.
2. App service
EZ Forms enables merchants to create forms, configure fields and appearance, display embedded forms, popups, or flyouts, collect responses and uploads, apply conditional logic, and receive email notifications. Features depend on the selected plan and may also depend on Shopify, the merchant's theme, and third-party services. The App is not a payment processor, confidential document repository, or emergency communication service.
3. Merchant responsibilities
- Configure and test forms, required fields, rules, uploads, redirects, and mobile layouts before publishing.
- Keep form content, privacy notices, and notification recipient addresses accurate.
- Collect only necessary information and obtain required rights, permissions, and consents.
- Review responses in the App and maintain any copies required for your business.
- Protect Shopify staff accounts, recipient inboxes, and downloaded files.
- Use the App in compliance with applicable law, Shopify policies, and these Terms.
4. Prohibited use
You may not use the App to violate law or third-party rights; collect passwords, payment-card data, or unnecessary sensitive information; distribute malware; interfere with the App; bypass access or billing controls; reverse engineer the App except where law prohibits restriction; or use the App for fraudulent, deceptive, abusive, or harmful activity.
5. Merchant content
You retain your rights in form configurations, text, images, and other materials you provide. You grant us the limited right to host, process, transmit, and display that content as needed to provide, secure, and support the App. You must have the rights required to use the content and must not submit material that infringes another person's rights.
6. Responses, uploads, and notifications
You determine the purpose and content of forms and are responsible for the lawfulness of submissions you request. Files are hosted using Shopify and may be accessible to anyone with their URL. Do not use the App for confidential or sensitive documents. Email notifications are processed asynchronously through a delivery provider; delays, spam filtering, and delivery failures can occur. Use the App's Submissions page to review recorded responses and do not rely on notification email for urgent or safety-critical purposes.
7. Plans, limits, and billing
The Free plan allows one form and 40 submissions per month. Premium allows unlimited forms and 1,000 submissions per month. Pro allows unlimited forms and 10,000 submissions per month. File uploads and conditional logic are included on Premium and Pro. Current prices, billing periods, trial terms, and applicable taxes are presented through Shopify before you approve a paid subscription.
Usage limits and feature access are enforced according to the selected plan. Deleting responses does not restore monthly submission allowance. A downgrade can make forms beyond the new plan limit unavailable on the storefront and restrict unsupported features; it does not by itself mean those forms are deleted. Further submissions may be rejected when the allowance is exhausted. Review the App's usage display after plan changes.
Paid subscriptions are billed through Shopify. You may cancel by uninstalling the App. Previously incurred charges and any refund request remain subject to Shopify's billing processes, the applicable subscription terms, and mandatory legal rights.
8. Support and updates
We provide reasonable support through the contact channels listed on our website. Response times are not guaranteed unless a separate written service-level agreement applies. We may release fixes, updates, or feature changes and may require reasonable configuration changes to maintain compatibility.
9. Availability and Shopify dependencies
We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability. The App relies on Shopify, internet services, themes, browsers, and other systems outside our control. Maintenance, security incidents, platform changes, or events beyond reasonable control may affect availability.
10. Intellectual property
The App, software, design, documentation, branding, and related materials are owned by Z Dzine or its licensors and are protected by intellectual-property laws. These Terms grant only a limited, non-exclusive, non-transferable, revocable right to use the App for your Shopify store during an active subscription or authorized access period.
11. Confidentiality
Each party may receive non-public information from the other. The receiving party will use reasonable care to protect confidential information and use it only to perform obligations or exercise rights under these Terms, except where disclosure is required by law.
12. Privacy and deletion
Our processing practices are described in the EZ Forms Privacy Policy. Merchants must provide appropriate notices, honor privacy rights, and avoid unnecessary data collection. Deleting responses is permanent and schedules tracked attachments for cleanup. Files may require retries to remove. Deletion does not recall delivered emails or remove merchant exports and recipient copies.
Remove unwanted Shopify-hosted files before uninstalling where possible. Once Shopify access is revoked, the App cannot guarantee removal of those files; merchants can manage remaining files in Shopify admin. App database records are handled through the Shopify shop-redaction process.
13. Disclaimers
To the maximum extent permitted by law, the App is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing. We do not guarantee that App configurations will satisfy your legal, tax, pricing, accessibility, or business requirements.
14. Limitation of liability
To the maximum extent permitted by law, Z Dzine will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption. Our aggregate liability arising from the App will not exceed the amount paid by you for the App during the six months preceding the event giving rise to the claim. Some jurisdictions do not permit certain limitations, so parts of this section may not apply.
15. Indemnification
To the extent permitted by law, you agree to defend and indemnify Z Dzine against third-party claims arising from your content, your configuration or use of forms, your violation of law or these Terms, or your infringement of third-party rights.
16. Suspension and termination
You may stop using the App by uninstalling it. We may suspend or terminate access where reasonably necessary for security, non-payment, prohibited conduct, legal compliance, Shopify requirements, or material breach. Provisions that by their nature should survive termination—including intellectual property, disclaimers, liability limits, and dispute provisions—will survive.
17. Changes to these Terms
We may update these Terms to reflect service, legal, or operational changes. We will revise the “Last updated” date and provide additional notice where required. Continued use after an update takes effect constitutes acceptance to the extent permitted by law.
18. Governing terms and disputes
These Terms are governed by the laws applicable where Z Dzine is legally established, excluding conflict-of-law rules. The parties will first attempt in good faith to resolve disputes informally. Nothing in these Terms limits mandatory rights or remedies that cannot lawfully be excluded.
19. General
These Terms and the referenced Privacy Policy form the agreement concerning the App unless a separate written agreement applies. If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, merger, acquisition, or transfer of the App.
